საჯარო სამსახურში საჩუქრის სამართლებრივი რეგულირების გამოწვევები თანამედროვე ქართულ კანონმდებლობაში

სტატია მიზნად ისახავს საჯარო სამსახურში საჩუქრის სამართლებრივი რეგულირების გამოწვევების იდენტიფიცირებას, რომელიც გავლენას ახდენს ეფექტურ მმართველობით პროცესზე. საქართველოს მოქმედი საკანონმდებლო მოწესრიგების პირობებში, ყოველთვის არსებობდა საჩუქრის საკითხის მარეგულირებელი ნორმების მკაფიო რეგლამენტირება/აღსრულების პრობლემა, რაც ერთ-ერთ დამაბრკოლებელ გარემოებას წარმოადგენს ეფექტური და ეფექტიანი მმართველობითი პროცესის განხორციელებისას. სტატიაში განხილულია გარემოებები, რომელიც მნიშვნელოვანია საჩუქრის საკითხის სათანადო რეგულირებისთვის, შეფასებულია საჩუქრის რისკები და მისი გადაჭრის ქმედითი მექანიზმები, გამოკვეთილია მკაფიო სამართლებრივი ნორმების საჭიროება და მასზე დაფუძნებული ქმედითი აღსრულების ინსტრუმენტების დამკვიდრება. შესწავლილი და დამუშავებულია საჩუქრის საკითხის მარეგულირებელი კანონმდებლობა, სხვადასხვა ავტორის სახელმძღვანელოები და სხვ. მოძიებული მასალების დამუშავებისთვის გამოყენებულ იქნა კვლევის როგორც ზოგადი ისე სპეციალური მეთოდები, მათ შორის ანალიზი და სინთეზი, სისტემური, შედარებით-სამართლებრივი მეთოდები.
