საქართველოს კონსტიტუციის შესაბამისად, საქართველოში საკონსტიტუციო კონტროლი ხორციელდება სპეციალურად შექმნილი ორგანოს – საქართველოს საკონსტიტუციო სასამართლოს მიერ. სწორედ საკონსტიტუციო სასამართლო გვევლინება ძირითადი უფლებების დაცვის გარანტად.
საკონსტიტუციო სასამართლოში ინდივიდუალური საკონსტიტუციო სარჩელის შეტანის გზით პირს შესაძლებლობა აქვს დაიცვას საკუთარი უფლებები. შესაბამისად, ინდივიდუალური საკონსტიტუციო სარჩელია ის მნიშვნელოვანი სამართლებრივი მექანიზმი, რომლის დანიშნულებას ეფექტური სამართლებრივი დაცვის უზრუნველყოფა და კონსტიტუციის დაცვა წარმოადგენს.
ინდივიდუალური კონსტიტუციური სარჩელის განხილვისას საკონსტიტუციო სამართალწარმოების თავისებურებებთან დაკავშირებით, არა ერთი პრობლემატური საკითხი არსებობს, თუმცა, მათი უმრავლესობა ჯერ კიდევ სათანადოდ არ არის შესწავლილი. შესაბამისად, წინამდებარე სტატიის მიზანია ადამიანის კონსტიტუციური უფლებებისა და თავისუფლებების დაცვის სფეროში საქართველოს საკონსტიტუციო სასამართლოს უფლებამოსილებასთან დაკავშირებული აქტუალური საკითხების შესწავლა, ინდივიდუალურ კონსტიტუციურ სარჩელთან დაკავშირებული სამართალწარმოების თავისებურებების გამოვლენა, არსებული თეორიული საკითხების ანალიზი და საკუთარი მოსაზრებების დაფიქსირება.
